WTO adopts EU fatty acid duties report
The WTO Dispute Settlement Body adopted a panel report finding the EU's anti-dumping duties on Indonesian fatty acid imports violated trade rules.

The World Trade Organization's Dispute Settlement Body has formally adopted a panel report concerning European Union anti-dumping duties on imports of fatty acid from Indonesia. The ruling, adopted on 28 August 2026, found the EU acted inconsistently with WTO rules by using an incorrect exchange rate for currency conversion in a portion of export transactions.
Indonesia welcomed the panel's findings and proposed the report's adoption. The country's delegation specifically highlighted the panel's conclusion that the EU had imposed a duty exceeding the established margin of dumping. This violation stemmed from a failure to use the exchange rate on the date of sale when converting certain euro-denominated export transactions to US dollars, breaching the WTO's Anti-Dumping Agreement. Indonesia stated it looks forward to the EU's prompt implementation of the rulings and expressed confidence in a shared commitment to resolve the matter effectively.
EU Response and Implementation Timeline
The European Union acknowledged the adoption while emphasizing the panel confirmed the WTO consistency of nearly all aspects of its investigation and definitive measure. The EU welcomed findings related to the investigation's continuation after a complaint withdrawal, the injury determination, and Indonesia's challenge to the methodology for constructing normal value. Regarding the specific violation, the EU characterized it as a narrow issue concerning the exchange rate used for currency conversion in a minor portion of export transactions.
The EU clarified that its decision not to appeal the findings should not be interpreted as an acceptance of the panel's legal reasoning. It further argued that the ruling should not be regarded as establishing a legal precedent for future disputes.
Under the WTO's Dispute Settlement Understanding, the European Union now has 30 days to inform the DSB of its intentions regarding implementation of the panel's recommendations. The next regular meeting of the Dispute Settlement Body is scheduled for 25 September 2026.
The dispute, officially designated DS622, centered on anti-dumping measures imposed by the EU on imports of fatty acid from Indonesia. The panel's report represents the final stage of adjudication in this case, barring any appeal, which the EU has declined to pursue. The process moves now to the compliance phase, where the EU must bring its measures into conformity with WTO obligations.
